1. Introduction and Acceptance of Terms

Welcome to mybevimi.com (the "Site"), owned and operated by Bevimi, Inc. and its affiliates (collectively, "Bevimi", "Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Site, including any content, features, products, and services offered through the Site (collectively, the "Services").

By accessing or using the Site, placing an order, creating an account, or otherwise engaging with our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (collectively, the "Agreement"). If you do not agree to these Terms, you must discontinue use of the Site and Services immediately.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of such changes. We encourage you to review these Terms periodically.

2. Eligibility

To use our Site and purchase our products, you must be at least eighteen (18) years of age or the legal age of majority in your jurisdiction, whichever is greater. By using the Site, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into a binding agreement.

3. Account Registration

4. Products, Orders, and Pricing

4.1 Product Descriptions

We strive to provide accurate descriptions, images, and pricing for all products on the Site. However, we do not warrant that product descriptions, images, pricing, or other content on the Site are accurate, complete, current, or error-free. If a product you have purchased is materially different from what was described on the Site, your sole remedy is to request a refund in accordance with our Refund Policy (see Section 6).

4.2 Pricing and Availability

All prices are displayed in U.S. dollars unless otherwise indicated and are subject to change without notice. We reserve the right to limit quantities, correct pricing errors, and discontinue products at any time. In the event of a pricing error, we may cancel any orders placed at the incorrect price and will notify you of the cancellation.

4.3 Order Acceptance

Your placement of an order constitutes an offer to purchase. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity. If we cancel an order after your payment has been processed, we will issue a full refund.

4.4 Payment

We accept the payment methods indicated at checkout. By providing payment information, you represent and warrant that you are authorized to use the payment method and that the information you provide is accurate. You authorize us to charge the applicable amount to your chosen payment method. All payments are processed through secure third-party payment processors; we do not store your full credit card information on our servers.

5. Subscription and Auto-Ship Terms

If you enroll in a subscription or auto-ship program, you authorize us to automatically charge your payment method at the selected frequency (e.g., monthly, every 60 days, or every 90 days) until you cancel. The subscription price at the time of renewal will apply. You may modify, pause, or cancel your subscription at any time by logging into your account or contacting us at hello@mybevimi.com. Cancellations must be made at least 3 business days before your next scheduled shipment to avoid being charged for that cycle.

We reserve the right to modify subscription pricing or terms upon reasonable advance notice. If you do not agree to modified terms, you may cancel your subscription before the next billing cycle.

6. Shipping, Refund Policy, and No-Return Policy

6.1 Shipping

We currently ship to addresses within the United States. Shipping times and costs are estimates and are not guaranteed. Risk of loss and title to products pass to you upon delivery to the carrier. We are not responsible for delays caused by the carrier, weather, customs, or other events beyond our reasonable control.

6.2 No-Return Policy

Due to the nature of our products, we do not accept returns. All sales are final except as expressly provided in Section 6.3. We are unable to accept returns due to the weight, fragility, and perishable nature of our products, as well as product safety and quality assurance considerations. We may establish a Return Policy in the future, in which case it will be posted on the Site and incorporated into these Terms.

6.3 Refunds for Damaged or Materially Misrepresented Products

While we do not accept returns, we stand behind the quality and accuracy of our products. You may be eligible for a refund in the following circumstances:

Damaged Products: If your order arrives with broken, leaking, or otherwise damaged bottles due to shipping, please contact us at hello@mybevimi.com within seven (7) days of delivery with photographs of the damage and your order number. We will issue a refund or replacement at our discretion.

Material Misrepresentation: If a product you received is materially different from its description on the Site (for example, incorrect product, substantially different ingredients or formulation from what was advertised), please contact us at hello@mybevimi.com within fourteen (14) days of delivery. We will review your claim and, if substantiated, issue a refund.

Refunds will be issued to the original payment method. Processing times may vary depending on your financial institution. All refund requests are subject to our Refund Policy, which is incorporated herein by reference and may be updated from time to time.

7. Health, Supplement, and Regulatory Disclaimers

7.1 FDA Disclaimer

The statements made regarding our products have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. 9. User-Generated Content

If you submit reviews, testimonials, comments, photos, or other content to the Site ("User Content"), you grant Bevimi a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with our business, including for marketing and promotional purposes, in any media now known or hereafter developed. You represent and warrant that you own or have the necessary rights to the User Content you submit, and that such content does not violate the rights of any third party. We reserve the right to remove any User Content at our sole discretion.

Prohibited activities include, but are not limited to: using the Site to transmit harmful, offensive, or illegal content; attempting to gain unauthorized access to our systems or other users' accounts; engaging in any activity that interferes with or disrupts the Site; using automated tools (bots, scrapers, etc.) to access or collect data from the Site; impersonating any person or entity; or reselling our products without our written authorization.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any product will meet your expectations or that results from any product will be achieved.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BEVIMI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, PRODUCTS, OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

Our total aggregate liability for all claims arising out of or relating to these Terms, the Site, or any product shall not exceed the total amount you paid to us for the specific product(s) giving rise to the claim during the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Bevimi, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or Services, your violation of these Terms, your violation of any applicable law or regulation, or your violation of the rights of any third party.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms and any disputes arising under or related to them shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

15.2 Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator in Delaware. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

15.3 Class Action Waiver

YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

15.4 Exceptions

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within that court's jurisdiction. Nothing in these Terms prevents either party from seeking injunctive or other equitable relief in court to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

16. Termination

We may terminate or suspend your access to the Site and Services, in whole or in part, at any time, with or without cause, with or without notice. Upon termination, your right to use the Site will immediately cease. 17. Electronic Communications

By using the Site and providing your email address, you consent to receive transactional electronic communications from us, including order confirmations, shipping updates, and account notifications. You acknowledge and agree that all agreements, notices, disclosures, and other communications provided to you electronically based on a transaction satisfy any legal requirement that such communications be in writing. If you elect to receive promotional communications from the Company, you may opt out of these messages at any time by following the unsubscribe instructions included in footer of those messages.

18. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and Bevimi regarding your use of the Site and Services and supersede all prior agreements.
